These Terms govern your use of Ziba AI ("the Service"), operated by B-ne Innovations Limited("we", "us") of Kitwe, Zambia. By creating an account or using the Service, you agree to be bound by these Terms.
1. Your account
You must be at least 13 years old to use the Service. You are responsible for keeping your login credentials secure and for all activity on your account. Notify us immediately if you suspect unauthorised access. We may suspend or terminate accounts that violate these Terms.
2. The Service
Ziba AI provides AI-generated answers grounded in a curated library of Adventist literature, with citations to source titles and page numbers. The Service is provided "as is" — while we work hard to keep it accurate and available, we make no warranty that it will be uninterrupted, error-free, or suitable for any particular use.
Answers are generated by a large language model and may contain errors despite our grounding constraints. You should verify important claims against the cited source. Ziba AI is a study aid, not a substitute for direct study of the original texts or counsel from qualified clergy.
3. Payments and subscriptions
- Pricing is shown on the pricing page in Zambian Kwacha (ZMW). Plans are sold in daily, weekly, and monthly billing periods.
- Payments are processed by Lenco. By submitting a payment, you authorise the charge for the selected plan and period.
- Subscriptions do not auto-renew unless explicitly stated at checkout. When the period ends, your account downgrades to the FREE tier; you can resubscribe at any time.
- We may change prices at any time. Price changes do not affect plans you have already paid for during the current period.
4. Refunds
Because the Service is consumed in real time (queries against the AI), payments are generally non-refundable. We will, however, refund or credit you in good faith for billing errors, double charges, or extended outages that prevented you from using a plan you paid for. Email support@b-ne.net with your payment reference within 14 days of the charge.
5. Quotas and fair use
Each plan has a query quota per billing period. You may not attempt to circumvent quota enforcement (multiple accounts, automated request floods, scraping). Such activity may result in suspension without refund.
6. Acceptable use
You agree not to:
- Use the Service to create content that violates the law, defames a person, or infringes intellectual property.
- Attempt to extract, mirror, or republish the underlying library wholesale.
- Probe, scan, or test the security of the Service without prior written permission.
- Use the Service to generate misleading content presented as official church teaching when it isn't.
- Submit prompts designed to exfiltrate the system prompt or destabilise the model's grounding constraints.
7. Content rights
Library content: the documents in the Ziba library are reproduced under licence from their copyright holders or, where applicable, from the public domain. Inclusion in Ziba does not grant you a separate licence to redistribute that content outside the Service.
Your inputs: you retain ownership of the questions you submit. You grant us a limited licence to process them as needed to deliver the Service (retrieval, generation, storage of your chat threads, and aggregate analytics that do not identify you).
AI outputs: outputs are generated for your personal study. You may quote and reuse them with appropriate attribution to the cited source documents (not to Ziba itself — Ziba is a tool, not the author).
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANSWERS WILL BE ACCURATE, COMPLETE, OR FREE FROM ERROR.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, B-NE INNOVATIONS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnity
You agree to indemnify and hold harmless B-ne Innovations Limited and its staff from any claims, damages, or expenses arising out of your misuse of the Service or your violation of these Terms.
11. Suspension and termination
We may suspend or terminate your access if you breach these Terms, fail to pay, or for activity that puts the Service or other users at risk. You may terminate by deleting your account at any time from the dashboard. Termination does not entitle you to a refund of fees already paid except as described under "Refunds" above.
12. Governing law
These Terms are governed by the laws of the Republic of Zambia. Any dispute arising out of or relating to the Service shall be subject to the exclusive jurisdiction of the courts of Kitwe, Zambia.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be flagged with a notice in-app or by email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance.
